A CHARTER ORDINANCE REPEALING CHARTER ORDINANCE NO. 7 OFTHE CITY OF ANTHONY KANSAS, EXEMPTING THE CITY OF ANTHONY, KANSAS, FROM K.S.A. 79-1952, INSOFAR AS THE RATE OF LEVY FOR LIBRARY PURPOSES IS CONCERNED, AND SUBSTITUTING AN ADDITIONAL RATE OF LEVY THEREFOR.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ANTHONY, KANSAS:

Section 1. The City of Anthony, Kansas, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, has by enactment of Charter Ordinance No. 17 exempted itself and does hereby elect to continue to exempt itself from and make inapplicable to it that portion of K.S.A. 79-1952 limiting the library levy of said city to 3.00 mills, and to provide substitute and additional provisions as set forth in said Charter Ordinance No. 17. K.S.A. 79-1952 is a part of an enactment of the legislature establishing limitations on certain tax levies, including the library levy, applicable to this city but not applicable uniformly to all cities, and the legislature has not established classes of cities for the purpose of imposing such limitations under said constitutional provisions.

Section 2. Amended. The City of Anthony, Kansas, is hereby authorized to levy a tax for library purposes at a rate of levy in any one year on each dollar of assessed tangible valuation of said city not to exceed seven mills.

Section 3. Charter Ordinance No.7 of the City of Anthony is repealed.
