A CHARTER ORDINANCE EXEMPTING THE CITY OF ANTHONY, KANSAS FROM THE PROVISIONS OF K.S.A. 14-1204, RELATING TO THE ELECTION OF OFFICERS; AND, PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT BY PROVIDING FOR A TERM OF OFFICE THAT WILL COINCIDE WITH THE FIRST MEETING OF THE GOVERNING BODY IN DECEMBER FOLLOWING A GENERAL ELECTION OF CITY OFFICIALS; AMENDING SECTIONS OF CHARTER ORDINANCE NO. 4 AND 20.

WHEREAS, the 2015 Kansas Legislature enacted L. 2015, Chapter 88, House Bill 2104 mandating new terms for the Governing Body which were established to be the second Monday in January; and,

WHEREAS, the 2015 legislative action did not permit a term of office to begin in December following an election and it conflicted with regular meetings of the Governing Body which are held on the first Tuesday in January; and,

WHEREAS, the 2019 Kansas Legislature enacted Senate Bill 105 to allow a City to establish a term of office on or after December 1 following certification of the election.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ANTHONY, KANSAS:

SECTION ONE. Charter Ordinance No. 4 and No. 20 is hereby amended to provide for a regular term of office that will expire and a new term of office that will commence with the first meeting of the Governing Body in December following a general election.

Officials elected at a November general election shall take office at the first meeting of the Governing Body in December following certification of the election, and no later than the second Monday in January.

SECTION TWO. Following the effective date of this Charter Ordinance, a portion of Section 3 of Charter Ordinance No. 4 shall be amended to read as follows:

       The terms of officers elected shall commence on the first meeting of the Governing Body in December following certification of the election, and the elected officers shall qualify by taking the oath or affirmation of office to be filed with the city clerk.

Following the effective date of this Charter Ordinance, Section 1(b) of Charter Ordinance No. 20 shall be amended to read as follows:

       Those positions that would have expired in January of 2022, shall expire on the first meeting of the Governing Body in December of 2021, when the city officials elected in the November 2021 general election take office. Those positions that would have expired in January 2024, shall expire on the first meeting of the Governing Body in December of 2023, when city officials elected in the November 2023 general election take office; and so on for each succeeding regular city election thereafter.
